A guide to some terms and conditions
of Using Water for Labour and/or Birth at Taranaki Base Hospital

While these are currently specific to Taranaki only, they may be used as a guide to ask questions of other facilities or encourage you to check the protocol of other facilities

...Use of the pool

  • The instructions included with the H2 Oh Baby! kit must be followed exactly as stated. The resolving of any issues arising from deviations from these instructions will be the user's sole responsibility.
  • Any excess water that is lost from the pool must be mopped up immediately, using the user's own towels in the first instance, to avoid any risk of slipping.
  • Access to the doors of the birthing suite and all the equipment in the suite must be clear at all times
  • The pool must be set up away from any electrical points or equipment. Any power points within one metre of the pool must be covered.

...Informed consent

  • The user of the pool will have read and understood the information given to her by her Lead Maternity Carer (L.M.C.) outlining the benefits and risks of using water for labour and birth preceding the onset of labour. She will have discussed this with her Lead Maternity Carer (L.M.C.) and all people likely to be present during the labour/birth.

...Support present

  • As well as the L.M.C., there will always be one other person present with the woman at all times that she is in the pool. Another person is also required to be on immediate call if required at any stage throughout the labour/birth process.
  • Hospital midwives are not expected to accept any involvement in issues relating to the practicalities of the pool such as the setting up, monitoring of temperature, emptying and maintenance.

...Faulty Goods

  • As stated in the Terms and Conditions upon purchasing of the H2 Oh Baby kit, H2 Oh Baby! strives to supply quality products and warrants them accordingly. At its sole discretion, H2 Oh Baby! will either repair or replace any products which fail because of demonstrable defects in materials or workmanship.
  • Under no circumstances will Taranaki District Health Board accept any responsibility or liability for any product failure of the H2 Oh Baby kit at any time.

...Liability

  • Subject to the Consumer Guarantees Act, Taranaki District Health Board shall not be responsible to the user for any loss, injury or damage to persons or property arising from the pool and related equipment or its use. The user indemnifies Taranaki District Health Board against any claim arising from the use or possession of the pool.
  • Taranaki District Health Board does not take any responsibility for any actions taken after the pool has been used at the hospital. The re-use of the pool for labouring or birthing again or for use as play equipment for children will be at the user's own risk and Taranaki District Health Board will not be responsible for any infection or other effect arising from any such re-use. The user indemnifies Taranaki District Health Board against any claim arising from such re-use.
  • The user indemnifies Taranaki District Health Board against any claim arising from failure to comply with any rules and regulations regarding fencing of pools while it is in the hospital grounds.

...Disputes

  • Any disputes concerning these terms and conditions that cannot be resolved by negotiation in good faith between the parties shall be determined by mediation or, failing that, by arbitration.
